Privacy

This privacy policy (“Policy”) describes how Wellian, Inc. (“Wellian”) collects, uses and shares personal information of users of Wellian Home Solution (the “Platform”). This Policy does not apply to any third-party sites, whose privacy policies you should review to determine how third-parties will handle your information.

PERSONAL INFORMATION

Personal Information means any information which related to an identified or identifiable natural person.

WHAT WE COLLECT

We collect information about you in the following ways.

 

Information You Give Us. We collect information that you provide to us directly, such as your‎ name and email, which includes information you give to us on our Platform or in response to one of our surveys.

 

Information You Share with Your Medical Provider. If you choose to connect the Platform to your medical provider, you will have the ability to communicate with your provider through the Platform.  Communications between you and your provider are stored in our system.

 

Information We Get From Third Parties. We may get information about you from third-parties who you authorize to provide information to us when you sign up for a subscription to the Platform.

 

Information Automatically Collected. We log information about your voice-controlled, listening device (i.e., Amazon Alexa), specifically your Alexa identification number and Alexa user ID generated by Alexa. In addition, when accessing our Platform, we may log your commands and requests, the device and model you use, and any information you voluntarily provide. 

USE OF NON-PERSONAL INFORMATION

We use your non-personal information to operate, maintain, and improve our Platform, products, and services.

USE OF PERSONAL INFORMATION

We use your personal information to:

  • Provide you with access to the Platform.

  • Provide you with customized content on the Platform.

  • To enable you to connect your Wellian account with your healthcare provider’s Wellian account so that you and your provider can communicate and share information with one another through the Platform.  You may choose to share historical data from the Platform with your provider by responding to provider requests for information.

  • Respond to any comments and questions you send to us, or to otherwise provide you with customer service.

  • Send information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages in relation to your use of the Platform.

  • Communicate with you about promotions, marketing and advertising, upcoming events, and other news about products and services offered by us and our selected partners.

  • Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

If you have provided your e-mail address to us, we’ll use it to (i) respond to your customer support inquiries, (ii) keep you informed of your Platform activity, and (iii) provide you with details of our Platform or other services, unless you have asked us to stop sending you our marketing material or opted out from our electronic marketing communications.  You can find out about opting out of marketing e-mails below in the section on “Information Choices and Changes.”

SHARING OF INFORMATION

The Alexa Skill enabled on the Platform is an audible technology.  When you use the Platform, you may expose your personal information to persons who are in the room with you when you use the Platform.  Please use caution when using the Platform if you do not want others near you to overhear your communications with the Platform.

We may share aggregated and/or anonymized data with third-parties for their own uses.

 

We may share your personal information as follows:

  • With your consent.

  • With your medical provider, if you choose to link your Wellian account to your healthcare provider’s account.

  • With Amazon, to the extent required by Amazon’s developer terms for the Platform’s Alexa Skill.  To create the Alexa Skill supplied by the Platform, we have agreed to the Alexa Skills Business Associate Agreement, which is an Amazon document that describes how Amazon may use your data.  You should review Amazon’s privacy policy and policies regarding Alexa and Alexa Skills to understand what data Amazon may receive.

  • We use a third-party payment service provider, Stripe, and a third party subscription service provider, Chargebee, to collect all the information necessary to complete the transaction and to create your subscription account. We share your information with these payment service providers to the extent necessary to complete your service request. In connection with the processing of such payments, we do not retain any financial information such as credit card numbers. Rather, that information is provided directly to our third party payment processor, Stripe, whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/us/privacy. Your subscription information, such as name, phone number, and email, is provided to our third party subscription processor, Chargebee, whose use of your personal information is governed by their privacy policy, which may be viewed at https://www.chargebee.com/privacy/.

  • We may share your information with other third-party service providers or with contractors who provide certain services to us or on our behalf, such as operating and supporting the Platform or otherwise responding to your customer service requests. These service providers, who are bound by contractual obligations to keep personal information confidential and use it for the purposes for which we disclose it to them, will only have access to the information needed to perform these limited functions on our behalf and are required to provide your information with at least the same level of protection and security as we use for the Platform.

  • If we do a business deal or negotiate a business deal involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, acquisition, or bankruptcy transaction or proceeding.  In such case, we will first notify you in accordance with local law requirements, if any, regarding those items of personal data that will be transferred, the name and contact details of the recipient, and inform you of how you can withdraw consent thereto.

  • For legal, protection, and safety purposes, such as:

    • To comply with laws.

    • To respond to lawful requests and legal processes.

    • To protect the rights and property of Wellian, our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use.

    • In an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.

INFORMATION CHOICES, CHANGES, AND DATA RETENTION

Please visit the privacy policy of the maker of your device for information about how you can access and control your personal information collected by the maker of your device. You can change or control your personal information that Wellian collects by voice command on your Alexa device when accessing the Platform on your Alexa device or in the Alexa app.


If you cancel your subscription, we will de-activate your account and ultimately delete your account.  We will also instruct our service providers to delete your personal information.  We do not receive any of your biometric information from Amazon and have no control over whether or not Amazon will delete your personal or biometric information.  Please note that we may retain information needed to resolve disputes, enforce our user agreements, protect our legal rights, and comply with technical and legal requirements and constraints. We may also keep information that has been aggregated or de-identified, so that the information cannot be reasonably traced to you.  For example, we might hold onto data that helps us understand preferences or concerns for a demographic or age range of users (i.e., most users who ask about hair loss are men between ages of 30-40). 

 

You may send questions about your personal information to our Contact Information below. We will do our best to honor your requests to change contact choices, opt-out of our sharing with others, and to update your personal information.

Opting Out of Direct Marketing from Us

We will only send you marketing emails if you opt-in to receiving such emails.

 

You can remove yourself from receiving email marketing from us at any time by simply clicking the unsubscribe link in any direct marketing email we send to you or sending an email to support@wellian.com.

SECURITY OF YOUR INFORMATION

We implement reasonable security measures to protect the security of your information and we are committed to the protection of your information. While we take reasonable precautions against possible security breaches of our Platform and our services, we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. Once we have received your information, we have procedures and security features in place to try to prevent unauthorized access. We urge you to take steps to keep your personal information safe. CHANGES TO THIS PRIVACY POLICY.  We may change this Policy, and if we make any substantial changes, we will notify you by sending you an e-mail to the last e-mail address you provided to us (if any), and/or by prominently posting notice of the changes on our Platform.  Continued use of our Platform following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
