This privacy statement (“Statement”) describes how Wellian, Inc. (“Wellian”) collects, uses and shares personal information of users of Wellian Home Solution (the “Platform”). This Statement does not apply to any third-party sites, whose privacy policies you should review to determine how third-parties will handle your information.

PERSONAL INFORMATION

Personal Information means any information which are related to an identified or identifiable natural person.

WHAT WE COLLECT

We collect information about you in the following ways.

 

Information You Give Us. We collect information that you provide to us directly, such as your‎ name and email, which includes information you give to us on our Platform or in response to one of our Surveys.

 

Information We Get From Third Parties. We may get information about you from third-parties who you authorize to provide information to us when you sign up for a subscription to the Platform.

 

Information Automatically Collected. We log information about your voice-controlled, listening device (i.e., Amazon Alexa), specifically your Alexa identification number and Alexa user ID generated by Alexa. In addition, when accessing our Platform, we may log your commands and requests, the device and model you use, and any information you voluntarily provide. 

USE OF NON-PERSONAL INFORMATION

We use your non-personal information to operate, maintain, and improve our Platform, products, and services.

USE OF PERSONAL INFORMATION

We use your personal information to:

  • Respond to any comments and questions you send to us, or to otherwise provide you with customer service;

  • Send information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages in relation to your use of the Platform;

  • Communicate with you about promotions, upcoming events, and other news about products and services offered by us and our selected partners.

  • Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

  • Provide and deliver products and services customers request. 

  • Associate your Amazon Alexa account in order to check your Wellian subscription status. Note that we use your email address in this way to check your Wellian subscription status and track how many times you have asked questions to ensure your usage is within the limit of your subscription plan.  But we do not use your email address to track the details of your activities.  For instance, we do not match your email address with the health conditions you are asking about. We use the Amazon Alexa Customer Contact API (https://developer.amazon.com/en-US/docs/alexa/custom-skills/request-customer-contact-information-for-use-in-your-skill.html) to access your email address with your permission. You provide us permission to access your email address via Amazon Alexa Customer Contact API inside the Alexa App. The first time you use/enable Wellian Alexa Skill, you will be asked to provide this permission. If you were using Wellian Alexa skill before, you are now required to provide this permission in order to be able to continue using our skill.

One important use of your information is communication. If you have provided your e-mail address to us, we’ll use it to (i) respond to your customer support inquiries, (ii) keep you informed of your Platform activity, and (iii) provide you with details of our Platform or other services, unless you have asked us to stop sending you our marketing material or opted out from our electronic marketing communications.  You can find out about opting out of marketing e-mails below in the section on “Information Choices and Changes.

SHARING OF INFORMATION

We may share aggregated and/or anonymized data with third-parties for their own uses.

We may share your personal information as follows:
 

  • With your consent.

  • We use a third-party payment service provider, Stripe, and a third party subscription service provider, Chargebee, to collect all the information necessary to complete the transaction and to create your subscription account. We never share your information except with these payment service providers and only to the extent necessary to complete your service request. In connection with the processing of such payments, we do not retain any personal information or any financial information such as credit card numbers. Rather, all such information is provided directly to our third party payment processor, Stripe, whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/us/privacy. Your subscription information such as password and email is provided directly to our third party subscription processor, Chargebee, whose use of your personal information is governed by their privacy policy, which may be viewed at https://www.chargebee.com/privacy/.

  • If we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, acquisition, or bankruptcy transaction or proceeding.  In such case, we will first notify you in accordance with local law requirements, if any, regarding those items of personal data that will be transferred, the name and contact details of the recipient, and inform you of how you can withdraw consent thereto.

  • For legal, protection, and safety purposes, such as:

    • To comply with laws.

    • To respond to lawful requests and legal processes.

    • To protect the rights and property of Wellian, our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use.

    • In an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.

  • With those who need it to perform work for us or to help perform the services you request.  We direct all such third-party recipients to maintain the confidentiality of the information disclosed to them and to not use your personal information for any purpose other than to provide services on our behalf.

INFORMATION CHOICES AND CHANGES

Please visit the privacy policy of the maker of your device for information about how you can access and control your personal information through your device. You can change or control your personal information by voice command on your Alexa device when accessing the Platform.


If you cancel your membership, we will de-activate your account and ultimately delete your account.  Please note that we may retain information needed to resolve disputes, enforce our user agreements, protect our legal rights, and comply with technical and legal requirements and constraints. We may also keep information that has been aggregated or de-identified, so that the information cannot be reasonably traced to you.  For example, we might hold onto data that helps us understand preferences or concerns for a demographic or age range of users (i.e., most users who ask about hair loss are men between ages of 30-40). 

 

You may send questions about your personal information to our Contact Information below. We will do our best to honor your requests to change contact choices, opt-out of our sharing with others, and to update your personal information.

Opting Out of Direct Marketing from Us

You can exercise choices over the direct marketing we send you in the following ways:

  • you can withhold your consent for us to send you direct marketing emails by opting out when we collect your email address;

  • you can remove yourself from receiving email marketing from us at any time by simply clicking the unsubscribe link in any direct marketing email we send to you or sending an email to support@wellian.com; and

SECURITY OF YOUR INFORMATION

We implement reasonable security measures to protect the security of your information and we are committed to the protection of your information. While we take reasonable precautions against possible security breaches of our Platform and our services, we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. Once we have received your information, we have procedures and security features in place to try to prevent unauthorized access. We urge you to take steps to keep your personal information safe. CHANGES TO THIS PRIVACY STATEMENT.  We may change this privacy statement, and if we make any substantial changes, we will notify you by sending you an e-mail to the last e-mail address you provided to us (if any), and/or by prominently posting notice of the changes on our Platform.  Continued use of our Platform following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
